MOBILE COUNTY, Ala. (WPMI) The controversial crude oil pipeline legal battle headed to court Thursday.Plains Southcap has filed a lawsuit against MAWSS over the pipeline. The company buongiorno venerdì 8 maggio is tryin gto get a piece of land condemned so it can continue building the pipeline.It's planned to run through adam scott Mobile's watershed.The judge said he wants to reveiw all the filing from Thursday before making a ruling. nwsl But Thursday was simply a heated debate about who legally has eminent domain power.Thursday, MAWSS asked the judge to dismiss the condemnation lawsuit altogether. Here's why: Alabama law states cities, counties, corporations and certain individuals can exercise eminent domain.MAWSS argued that the law doesn't apply to Plains Southcap. MAWSS claims Plains Southcap is an LLC, not a corporation and therefore doesn't have eminent domain power.Yet Plains argued it does apply because it operates as a corporation.Local 15's Modupe Idowu caught up with Plains attorney after the hearing Thursday.I think our pleadings speak for ourselves. I think Plains Southcap clearly has authority to condemn. The public service commission has determined that this court has and the law supports us, thanks you, said Jarrod White.The Alabama Public Service Commission did indeed grant Plains Southcap eminent domain, but now the decision rests in Judge Davis' hands.
