The Supreme Court of India took up the matter on 8 May 2026 before a bench of CJI Surya Kant and Justice Joymalya Bagchi, where it passed important interim directions (not a final judgment) to address the alarming rise in serious criminal cases.

The Court directed the establishment of exclusive special courts under the National Investigation Agency (Section 11, NIA Act) for speedy trials and laid down a clear formula for dedicated courts—one court for around 10 pending cases, two courts if cases exceed 15, and three courts if cases go beyond 25, with only a few states possibly requiring more depending on pendency.

It was further directed that these courts be set up within one month in consultation with High Courts and State Governments, ensuring proper infrastructure, manpower, and space, and that day-to-day hearings gt vs rr be conducted with an effort to conclude at least one trial per month.

The Court also sought detailed data from states regarding pending cases under Section 22 (state-prosecuted matters) before issuing further directions.

During the hearing, the bench made strong observations on the growing drug menace under the NDPS Act, with the CJI referring to a heartbreaking instance of a 60-year-old mother who lost all her five sons to drug addiction, calling the situation “alarming.”

The Court criticized the police approach of targeting small offenders for publicity instead of going after the “big sharks” and organized networks, and stressed the need for stricter enforcement.
